These Terms of Use govern your access to and use of luxusblumen.com (the “Site”), owned and operated by Luxus Blumen S.A., Pedro Moncayo, Pichincha, Ecuador (“Luxus Blumen”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Purpose of the Site

The Site presents Luxus Blumen, our farm and our products, and allows professional buyers to contact our sales team. It is informational and does not sell products online. Quotes, orders, prices, availability, shipping and payment are governed exclusively by the specific commercial agreements made with each customer.

2. Product information

Varieties, colors, stem lengths, availability and any other product information shown on the Site are for reference only and may change without notice. Colors in photographs may vary depending on the screen, lighting and the natural variation of each crop. The Site does not constitute a binding offer.

3. Intellectual property

All content on the Site, including photographs of our flowers and farm, texts, catalog layouts, graphic design, logos and the “Luxus Blumen” name and brand, is owned by Luxus Blumen S.A. or used under license, and is protected by Ecuador’s Organic Code of the Social Economy of Knowledge, Creativity and Innovation (Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación) and by international copyright and trademark treaties.

Unless you have our prior written authorization, you may not:

  • copy, download, reproduce, distribute, publish, modify or sell any photograph or content from the Site;
  • use our photographs, catalog or brand in your own catalogs, websites, marketplaces, social media or advertising, or present them as your own products;
  • extract content from the Site by automated means (scraping, bots or similar tools); or
  • remove or alter any copyright or ownership notice.

Viewing the Site on your screen for the purpose of evaluating a commercial relationship with Luxus Blumen is permitted. To request authorization to use our images, for example as a customer promoting our flowers, write to sales@luxusblumen.com.

Flower variety names may be trademarks or plant variety rights belonging to their respective breeders and are used for identification purposes only. Certification logos, such as Florverde, belong to their respective owners and are displayed under the terms of the corresponding certification.

4. Acceptable use

You agree to use the Site lawfully and not to: send false information or information belonging to third parties through our forms; send spam or malicious content; attempt to access restricted areas of the Site or its systems; or interfere with its normal operation.

5. Third-party links

The Site includes links to third-party services such as WhatsApp, Google Maps, Facebook and Instagram. We do not control these services and are not responsible for their content or practices.

6. Limitation of liability

The Site is provided “as is”. We work to keep it accurate, available and secure, but we do not guarantee that it will be free of errors or interruptions. To the extent permitted by law, Luxus Blumen shall not be liable for damages arising from the use of, or the inability to use, the Site or its content.

7. Privacy

The personal data you send us through the Site is processed in accordance with our Privacy Policy.

8. Changes

We may update these Terms at any time. The current version will always be available on this page, with the date of the latest update shown at the top.

9. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Ecuador. Any dispute arising from the use of the Site shall be submitted to the competent judges and courts of the Province of Pichincha, Ecuador.
