Privacy Policy

Luxus Blumen S.A. (“Luxus Blumen”, “we”, “us”) respects your privacy. This Privacy Policy explains what personal data we collect through luxusblumen.com (the “Site”), why we collect it, how we protect it and the rights you have over it. It has been prepared in accordance with Ecuador’s Organic Law on Personal Data Protection (Ley Orgánica de Protección de Datos Personales, “LOPDP”) and its regulations.

2. Personal data we collect

We only collect the data you choose to give us and the minimum technical data needed to run the Site securely:

  • Contact form: name, company, email address, country, the product lines you are interested in and your message.
  • Catalog requests: your name and, optionally, your company. This information is also used to open a pre-filled WhatsApp conversation with our sales team.
  • Direct communications: any information you share with us by email, WhatsApp or phone.
  • Technical data: IP address, browser type, device and access times, recorded automatically by our hosting provider in server logs for security and to prevent abuse.

We do not collect sensitive data, we do not sell personal data, and the Site does not use analytics, advertising or tracking cookies.

3. Why we use your data and on what legal basis

  • To answer your inquiries, send quotes and product information, and take the steps you request before a possible commercial relationship (pre-contractual measures and your consent).
  • To manage an existing commercial relationship with your company (performance of a contract).
  • To keep the Site secure, prevent spam and abuse, and comply with legal obligations (legitimate interest and legal obligation).

We will not use your data for purposes incompatible with those listed above without informing you and, where required, obtaining your consent.

4. Who we share your data with

Your data is accessed only by authorized Luxus Blumen personnel. We rely on trusted service providers who process data on our behalf and under our instructions:

  • Website hosting provider (Hostinger).
  • Our corporate email service provider.
  • WhatsApp (Meta Platforms), only when you decide to contact us through WhatsApp.

We may also disclose data when required by law or by a competent authority.

5. International transfers

Some of these providers may store or process data on servers located outside Ecuador. When this happens, we take reasonable measures so that your data receives a level of protection consistent with the LOPDP.

6. How long we keep your data

We keep inquiry and contact data for as long as needed to respond to you and, if a commercial relationship follows, for its duration. Inquiries that do not lead to a commercial relationship are deleted within three (3) years of the last contact, unless a longer period is required by law.

7. Your rights

Under the LOPDP you have the right to:

  • access your personal data;
  • request its rectification and updating;
  • request its deletion;
  • object to its processing;
  • request the portability of your data;
  • request the suspension of processing;
  • not be subject to decisions based solely on automated processing; and
  • withdraw your consent at any time, without affecting processing carried out before the withdrawal.

To exercise any of these rights, write to sales@luxusblumen.com with the subject “Personal data”. We will respond within the time limits established by law. If you are not satisfied with our response, you may file a complaint with Ecuador’s Superintendency of Personal Data Protection (Superintendencia de Protección de Datos Personales).

8. Cookies

The Site only uses technical cookies that are strictly necessary for it to work and for its administration. We do not use cookies for analytics, advertising or profiling. You can delete or block cookies at any time in your browser settings.

9. Security

We apply technical and organizational measures to protect your data, including encrypted connections (HTTPS), restricted access to the administration area and protections against automated spam. No system is completely secure, but we work to protect your information and to act promptly if an incident occurs.

10. Minors

The Site is intended for businesses and professionals in the floral industry. We do not knowingly collect personal data from minors.

11. Third-party links

The Site contains links to third-party services such as WhatsApp, Google Maps, Facebook and Instagram. Their use is governed by their own privacy policies, which we encourage you to read.

12. Changes to this policy

We may update this Privacy Policy from time to time. The current version will always be available on this page, with the date of the latest update shown at the top.
